Acceptance of the general conditions and terms

The subscription to Paninidigital.com implies acceptance of the following General Conditions and Terms:

The General Conditions relating to supscription to Paninidigital.com the use of related Services are subject to obtaining consent from the User’s to use his/her date appropriately, in accordance with Law 675/96 Italian Law (Privacy Law). Information about this is available prior to registration.
Users must guarantee the accuracy of the data supplied upon subscribing to the service.
Panini will reserve the right to cancel the subscription or interrupt the supply of the services should the data provided by the User prove to be false.
Refusal to accept the General Conditions and Terms clause will cause the immediate cancellation of the User’s subscription to Paninidigital.com

Duration and withdrawal
Simple subscription to Paninidigital.com, which does not involve payment, is of unlimited duration and may be cancelled at any time by the User.Withdrawal from the service is achieved by entering into the website’s section “Modify Profile”
Services requiring payment are available for a predetermined amount of time, which varies according to the subscriptions selected.
The consumer’s right to withdraw as stated in Article 5, (i) of the Italian Law D. Lgs 22 May 1999 (no 185) is not applicable in this case because it is possible that, after the validation of the contract, Panini’s services will begin before the ten day “cooling off period” has finished.

Suspension of s ervices and contract cancellation
1) Should the User make use of the services offered by Paninidigital.com for illegal methods or purposes
2) Should the User abuse the data and images included in the website (unauthorized publications, multiple access to the Data Base)
If Panini decides to cancel the contract, a refund will not be granted.

Modification of the General Terms and Conditions
Panini reserves the right to modify the present General Terms and Conditions.
Panini will notify the User in good time of every modification via Internet, with a specific message inserted in the web section “Subscription”
Modifications to existing contracts will take effect 16 days after the formal date of communication, unless the User utilizes the services during this period. In this case, the modifications will be considered accepted.
On the basis of the terms specified herein, letter the User will be able to withdraw from the service, should the changes to the General Terms and Conditions prove unsatisfactory for his/her needs, by notifying Panini of his/her decision via registered letter.

Password and User’s security
The subscriber is responsible for keeping his/her password and user id secret.
The subscriber is obliged to immediately inform Panini by e-mail (info@paninidigital.com) should any unauthorized usage of his/her personal id and/or password or any other violation of security come to his/her attention. 
The User can at any stage change his/her personal password following the instructions provided.

Responsibility Limitation
Panini does not accept responsibilty for damages, requests or losses, whether direct or undirect, deriving faulty electronic equipment belonging to either the User or a third party.
Panini cannot be held responsible should fulfilment of its contractual requirements prove impossible due to circumstances beyond Panini’s control, or due to the User’s inability to access to the Web for any reasons beyond Panini and its partners’ control.
Should there be an interruption to the service due to circumstances proven to be under Panini’s control, only Users paying for subscriptions will be granted a free extension of their contract, which will be in proportion to the duration of the interruption.

Prohibition of any commercial use of the services
Services offered through the website www.paninidigital.com are for personal use only. The User can only be one person. By agreeing to these Terms and Conditions, the User consents to consult the website only for personal matters and not for commercial purposes.

Release Terms
The User agrees to not damage Panini and releases Panini and its partners by not claiming any compensation for damages, refunds or recoupment, even legal, for any illegal or unauthorized usage of the website’s contents.
The prolonged usage of the site’s services from the User will be considered as a confirmation of the subscriber’s will to accept the present general terms and condition, to eventual particular condition and relevant further modifications.

Panini SpA (Panini ) supplies the information regarding use of the personal data supplied for subscription to the Paninidigital.com and the Services within (Paninidigital.com Services) in observance of Law Art. 13 D. Lgs. 30 June 2003, N° 196 regarding the rights of the individual and use of personal data.

INFORMATIVA

As stated in Art. 13 D. Lgs. 30 June 2003, N° 196 we inform you of the following:

personal data gathered will be used for the purposes of registering for the Paninidigital.com and the other Panini Web Sites;

1) to assist you during use of Paninidigital.com and related Services to which you have subscribed
2) to send you information about using Paninidigital.com and its Services
3) to notify business customers about  Panini's new initiatives. In addition, after the analysis of data has taken place (which will be on a group basis only), information pertaining to publicity banners on the Paninidigital.com pages and its Services will be supplied.

The conferral of personal data is obligatory for subscription to the Paninidigital.com and its Services.

The personal data supplied by you will be communicated exclusively to:
1) companies linked or controlled by our group;
2) public or private bodies in compliance with any obligation imposed by law;
3) the personal data supplied might be transferred abroad, if consent is provided and within the limits imposed under Art. 13 D. Lgs. 30 June 2003, N° 196.

AArt. 13 D. Lgs. 30 June 2003, N° 196 awards you certain rights relating to the treatment of your personal data, amongst which are the following:
1) the right to gain the information, by means of access to the register as provided by Article 31 L.675/96, or asking those responsible about the use of data which might be related to you;
2) the right to obtain an update, amendment or integration of any data, the right to ask for the cancellation of, the right to keep it anonymous or to block data when it is used in breach of the law;
3) the right to oppose any use of the data within the areas above mentioned only for legitimate reasons;

The holder and company responsible for the use of the data is Panini SpA. This  right will be held by the person who is the legal representative of the company, except where a specific person has been named under Art. 13 D. Lgs. 30 June 2003, N° 196.
